壹、服務對象
本系統服務對象僅限於全國各大學校院正在撰寫學位論文,且尚未於「臺灣博碩士論文知識加值系統」建檔之應屆畢業碩博士學生。

貳、服務聲明
一、上傳至本系統之檔案,應為使用者為該畢業學年度學位論文考試所撰寫之學位論文PDF檔,若不符合者即違反本規範。
二、使用者上傳的檔案僅供使用者個人比對之用;上傳之檔案不會儲存至本系統比對文件庫。
三、上傳至本系統之檔案應為使用者之著作或已徵得著作權人同意上傳之著作,不得上傳未經授權之任何檔案。若使用者上傳任何違反著作權法或學術倫理之資料,應自行負擔相關的法律責任。
四、為保障著作權及學術誠信,本系統將對上傳的論文進行自動化檢測,以供判斷其原創性及學術誠信。上傳的學位論文應符合各校、系所論文撰寫規範或符合「科學研究論文的基本架構」(引言、方法、結果與討論)格式,以利本系統正確剖析論文之章節結構。
五、本系統及其服務不保證可滿足使用者的所有要求或期望,一切服務以本系統提供之現況為準。本系統產生的結果或比對是否完整或正確,系統管理者未做出任何保證與承諾。

參、使用者公約
一、同意於本系統所發表或傳輸的一切內容,應負所有法律責任。
二、承諾遵守中華民國相關法規及一切國際網際網路規定與慣例。
三、同意並保證不於本系統公布或傳送任何毀謗、不實、威脅、不雅、猥褻、不法、攻擊性、危害國家安全或侵害他人智慧財產權的文字、圖片或任何形式。
四、同意遵守智慧財產權,不擅自重製、傳輸、改作、編輯或以其他任何形式、基於任何目的加以使用本系統提供之內容,否則應負所有法律責任。
五、同意不對本系統進行逆向工程、解構、解譯、反編譯、大量上傳、網路爬蟲等異常、惡意操作。
六、本系統就使用者的行為是否符合使用者規範,有最終決定權。若本系統認定使用者的行為違反本規範或任何法令,使用者同意系統管理者得隨時停止帳號使用權或清除帳號,及停止使用本系統服務。使用者違反法律規定之情事,應自負法律責任。
七、若因使用者之異常、惡意操作以至本系統軟硬體毀損,使用者應負損害賠償責任;若因使用者之異常、惡意操作致本系統雲端租賃費用增加,使用者應負擔其造成之額外雲端租賃費用,即您同意對使用本系統的相關損害或損失負責。
八、本系統不代表所有文章言論、連結、照片或檔案之立場或版權責任,使用者所發表之任何言論、文章、連結、照片或檔案僅代表該作者(發表人)之立場;系統管理者可以在任何時間刪除之。
九、使用者若涉及不法情事,除應由使用者自負法律責任外,本系統將主動配合相關主管機關調查處理。

肆、規範之修改
系統管理者保留隨時修改本規範之權利,修改規範時,將於本系統首頁公告修改之內容,不另行個別通知,使用者須遵守最新的使用規範。

伍、服務之停止與更改
系統管理者保留隨時停止或更改各項服務內容或終止任一使用者帳戶服務之權利,且無需事先通知使用者。無論任何情形,就停止或更改服務或終止使用者帳戶服務所可能產生之困擾、不便或損害,本系統對任何使用者或第三人均不負任何責任。

一、於發生下列情形之一時,本系統有權停止或中斷提供服務:
(一)對本系統之軟硬體系統進行必要之保養、施工或維護時。
(二)發生突發性相關電子通信設備故障時。
(三)由於天災等不可抗力之因素致使本系統無法提供服務時。
二、 使用者應瞭解並同意,本系統可能因相關單位軟硬體設備之故障或失靈、或人為操作上之疏失而全部或部分中斷、暫時無法使用、遲延、或造成資料傳輸或儲存上之錯誤、或遭第三人侵入系統篡改或偽造變造資料等,使用者同意自負風險,不得因此而要求任何補償或賠償。
三、本系統得不經通知,隨時取消或停止使用者之使用者資格,或加以限制,使用者不得因此要求補償或賠償。
四、本系統保留將來新增、修改或刪除本服務之全部或一部之權利,且不另行個別通知,使用者不得因此而要求任何補償或賠償。

陸、保管及通知義務
使用者有義務妥善保管在本系統之帳號與密碼,並為此組帳號與密碼登入系統後所進行之一切活動負責。為維護使用者自身權益,請勿將帳號與密碼洩露或提供予第三人知悉,或出借或轉讓他人使用;且每次連線完畢,應登出結束帳號使用,以避免帳號遭盜用或濫用。若使用者發現帳號或密碼遭人非法使用或有任何異常破壞之情形時,應立即通知系統管理者。

柒、個人資料及論文
一、使用者於本系統註冊之資料,將依照國家圖書館全球資訊網「隱私權政策」及「資訊安全政策」受到保護與規範。
二、使用者所登錄或留存於本系統之個人資料及所上傳之論文,依據「個人資料保護法」第16條第5項規定,國家圖書館得以蒐集。使用者同意本系統得於合理之範圍內蒐集、處理、保存、傳遞及使用該等資料,以提供使用者其他資訊或服務、或作成使用者統計資料、或進行關於網路行為之調查或研究,或為任何之合法使用。

捌、損害賠償
因使用者違反相關法令或違背本服務條款之任一項目,致本系統或其他相關履行輔助人因此而受有損害或支出費用(包括且不限於因進行民事、刑事及行政程序所支出之律師費用)時,使用者應負擔損害賠償責任或補償其費用。

玖、準據法及管轄法院
本服務條款之解釋及適用,以及使用者因使用本服務而與本系統間所產生之權利義務關係,應依中華民國法令解釋適用之。其因此所生之爭議,以臺灣臺北地方法院為第一審管轄法院。

壹拾、附錄
個人資料保護法第16條(修正日期:民國112年05月31日)

公務機關對個人資料之利用,除第六條第一項所規定資料外,應於執行法定職務必要範圍內為之,並與蒐集之特定目的相符。但有下列情形之一者,得為特定目的外之利用:
一、法律明文規定。
二、為維護國家安全或增進公共利益。
三、為免除當事人之生命、身體、自由或財產上之危險。
四、為防止他人權益之重大危害。
五、公務機關或學術研究機構基於公共利益為統計或學術研究而有必要,且資料經過提供者處理後或蒐集者依其揭露方式無從識別特定之當事人。
六、有利於當事人權益。
七、經當事人書面同意。

Thank you for using the “WriteAid Similarity Scanner”. To protect your rights and interests, please read the following guidelines carefully. By clicking the “I accept” option online, you indicate that you accept the services provided by the system and agree to comply with all the guidelines outlined below.


I.Service Target

The intended users of this system’s services are limited to current graduate students who are in the process of writing their thesis or dissertation and have therefore not yet been registered in the “National Digital Library of Theses and Dissertations in Taiwan” database.


II.Service Statement

1. Files uploaded to the system should be the PDF document of the user’s thesis or dissertation written for the degree examination of the current academic year. Any file that does match this description will be in violation of this regulation.
2. Files uploaded by the user will only be used solely to generate comparison report for the user. No uploaded files will be stored in the system’s comparison database.
3. Files uploaded to the system should be the user’s own work or files that the user have obtained consent from the copyright owner to upload. Users are not allowed to upload any unauthorized files. Users are responsible for any legal consequences arising from the upload of materials violating copyright laws or academic ethics.
4. To protect copyright and academic integrity, the system will automatically check the uploaded thesis or dissertation for originality and academic integrity. Uploaded thesis and dissertation should comply with the writing guidelines of the user’s own respective university, department, or comply with the “IMRAD” (Introduction, Methods, Results, and Discussion) format to facilitate accurate analysis of the thesis or dissertation structure by the system.
5. This system and its services do not guarantee to meet all requirements or expectations of the users. All services are provided as-is by the system. The system administrators makes no guarantee or promises regarding whether the results generated by the system or its comparisons are complete or correct.


III.User Agreement

1.Users agree that all content published or transmitted through the system entails legal responsibility for the user.
2.Users commit to comply with all relevant laws and guidelines of the Republic of China (Taiwan) and all international Internet guidelines and conventions.
3.Users agree and guarantee not to publish or transmit any defamatory, false, threatening, indecent, obscene, unlawful, offensive, or harmful content, including text, images, or any other form, that could jeopardize national security or infringe upon the intellectual property rights of others.
4.Users agree to respect intellectual property rights and not to reproduce, transmit, modify, edit, or use the content provided by the system in any form, for any purpose without authorization, otherwise, bear all legal responsibilities.
5.Users agree not to engage in reverse engineering, decompiling, decoding, reverse compiling, mass uploading, web crawling, or any other form of abnormal or malicious operations to the system.
6.The system has the final decision-making authority on whether a user’s behavior complies with the user guidelines. If the system determines that the user’s behavior violates the user guidelines or any laws, the user agrees that the system administrators may suspend the account usage rights or delete the account and terminate access at any time. Users should bear legal liability for any violations of laws and regulations.
7.If the user’s abnormal or malicious operations result in damage to the software or hardware of the system, the user should bear the liability for damages; if the cloud rental costs of the system increase due to the user's abnormal or malicious operations, the user shall bear the additional cloud rental costs caused, i.e., you agree to be responsible for any related damage or loss caused by using this system.
8.The system does not represent the views or copyright responsibilities of all articles, opinions, links, photos, or files. Any comments, articles, links, photos, or files published by users only represent the views of the respective authors (publishers). The system administrators reserve the right to delete them at any time.
9.If users engage in unlawful activities, in addition to the user’s own legal liabilities, the system will actively cooperate with the associating authorities to investigate such matters.


IV.Modification of Guidelines

The system administrators reserve the right to modify these guidelines at any time. When making modifications, the amended content will be announced on the homepage of the system, without separate individual notifications. Users are required to comply with the latest version of the user guidelines.


V.Suspension and Modification of Services

The system administrators reserve the right to suspend or modify any service content or terminate any user account service at any time without prior notice to users. In any case, the system is not liable for any inconvenience, disruption, or damages caused by the suspension or modification of services or the termination of user account services, to any user or third party.

1. The system has the right to suspend or interrupt the provision of services under the following circumstances:
(1) Necessary maintenance, construction, or repair of the software and hardware systems of the system.
(2) Sudden failures in related electronic communication equipment.
(3) Inability to provide services due to force majeure events such as any natural disasters.
2. Users should understand and agree that the system may experience interruptions, temporary unavailability, delays, errors in data transmission or storage due to hardware or software failures, or due to human operational negligence. It could also be subject to third-party intrusion, tampering, or forgery of data. Users agree to bear the risk themselves and shall not demand any compensation or reimbursement for these issues.
3. The system may cancel or suspend a user’s eligibility or impose restrictions at any time without notice. Users should not demand compensation or damages as a result.
4. The system reserves the right to add, modify, or delete all or part of the services in the future, without individual notifications, and users may not demand any compensation for these changes.


VI.Obligations of Custody and Notification

Users have an obligation to properly safeguard their account username and password for the system and are responsible for all activities conducted with their account and password after logging into the system. To protect their own rights and interests, users should not disclose or provide the account and password to third parties, nor should they lend or transfer them to others to use. After each session, users should log out and end the account usage to prevent their accounts from being stolen or misused. If users discover that their account or password has been illegally used or there is any abnormal damage, they should immediately notify the system administrator.


VII.Personal Information and Theses

1.The information provided by the users during registration will be protected and regulated according to the Network of National Central Library’s “Privacy Policy” and “Information Security Policy”.
2.Personal information registered or stored by users in this system, as well as the thesis or dissertation documents uploaded, may be collected by the National Central Library in accordance with Article 16, Paragraph 5 of the Personal Data Protection Act. Users agree that the system may collect, process, preserve, transmit, and use such data within a reasonable scope to provide additional information or services to users, compile user statistical data, conduct investigations or research concerning online user behavior, or for any other legal uses.


VIII.Damages and Compensation

If users violate relevant laws or any provisions of these Terms of Service, resulting in damages or expenses incurred to the system or other related parties (including but not limited to legal fees incurred in civil, criminal, and administrative procedures), users should bear the liability for compensation or reimbursement of such expenses.


IX.Applicable Law and Jurisdiction

The interpretation and application of these Terms of Service, as well as the rights and obligations between the users and the system arising from the use of the service, should be governed by the laws of the Republic of China (Taiwan). Any disputes arising from this should be under the jurisdiction of the Taipei District Court in Taiwan as the court of first instance.


X.Appendix

Article 16 of the Personal Data Protection Act (Amended Date: 2023-05-31) The use of personal data by public agencies, except for the data specified in Article 6, Paragraph 1, should be within the scope necessary for the execution of statutory duties and in accordance with the specific purposes for which it was collected. However, use for purposes other than those specified is permitted in the following circumstances:
1. Where explicitly stipulated by law.
2. To maintain national security or enhance public interest.
3. To prevent imminent danger to the life, body, freedom, or property of the individual concerned.
4. To prevent significant harm to the rights of others.
5. Where necessary for public interest statistical or academic research by public agencies or academic research institutions, provided the data is processed by the provider or the collector in a manner that does not identify specific individuals.
6. When it is beneficial to the interests of the individual concerned
